Hospedar Servidores da Rede Indymedia é Ilegal?
Nessa segunda-feira (9 de fevereiro de 2009), a policia de Kent prendeu um homem em Sheffield, enquadrando-o sob a Lei de Crimes Graves 2007 em relação à recente apreensão do servidor da Rede Indymedia. A casa dele foi invadida, e todos os equipamentos de computadores e documentos relacionados foram levados. Ele foi liberado após oito horas. A pessoa não tinha nenhum acesso técnico, administrativo ou editorial ao site Indymedia do Reino Unido. Ele só estava associado ao projeto por hospedar um servidor da Rede.A prisão ocorreu sob a Seção 44-46 da Serious Crime Act, que foi aprovada como lei no dia 1º de Outubro de 2008 para combater graves crimes internacionais como tráfico de drogas, prostituição, lavagem de dinheiro e assalto à mão armada. As seções 44-46 referem-se a "incentivar ou apoiar delitos"A polícia de Kent reivindica os endereços de IP de duas publicações de comentários anônimos em um relatório sobre um recente processo judicial que julgou uma ação de libertação animal, os comentários tinham em seu conteúdo detalhes pessoais de um juiz. O endereço de IP de quem publicou estes comentários não está gravado, pois o Indymedia Reino Unido não loga endereços de IP. Esse fato foi reconhecido pela Polícia do Transporte Britânica em 2005, após a apreensão do Servidor do CMI Bristol.O fato da polícia prender a pessoa que tinha assinado o contrato de hospedagem de um servidor, reflete em pura intimidação, já que claramente a Rede Indymedia tem sua política declarada de não logar IP.Com a implementação da Diretiva de Retenção de Dados da União Européia em Março de 2009, o governo britânico tenta tornar cada provedor de serviços de internet no país em um instrumento de aplicação da lei. A legislação fornecerá uma base legal para intimidar, perseguir e prender pessoas que estão desenvolvendo um valioso e necessário trabalho para a transformação social, como por exemplo, ativistas pela paz, militantes que lutam por justiça social e econômica ou contra a brutalidade policial.A atual intimidação do meio alternativo de publicação aberta que é a Rede Indymedia terá sérias implicações para qualquer pessoa que queira hospedar um servidor no Reino Unido que permita contribuição de usuários/as - blogs, sites de redes sociais, wikis.
